On Thursday, NOTUS reported that Supreme Court Justice Samuel Alito’s son Phillip Alito has been working as a political appointee in the office of the Treasury Department’s general counsel since early 2025. During that time, Justice Alito failed to recuse from Learning Resources, Inc. et al v. Trump et al, a major case in which the Treasury Department was a named party.
In response to Alito’s brazen failure to recuse from a case in which he was conflicted, Revolving Door Project Executive Director Jeff Hauser said:
“Roberts’ Supreme Court has long made its North Star permitting the rich and powerful to do as they wish, from legalizing white collar crime to slashing campaign finance regulations. Now the Roberts Supreme Court has accelerated their own flouting of judicial ethics, as Justice Alito has done yet again by failing to recuse from a case involving his adult son’s workplace–and potentially his actual work product.”
“Phillip Alito’s quiet ascent to an influential position in the Trump administration poses a conflict with Justice Alito’s ability to impartially oversee Treasury Department matters, even as conflicts relating to adult children have too often been ignored under the law.”
Revolving Door Project Executive Director Jeff Hauser continued:
“Justice Alito should recuse himself from overseeing challenges to Trump’s corrupt ‘Anti-Weaponization Fund’ as well as any future issues pertaining to Trump’s Treasury Department.”
“This revelation is only the latest demonstration of Justice Alito’s cavalier and dismissive approach to ethics compliance. The Revolving Door Project was one of thirty organizations that recently called on the Senate Committee on the Judiciary to investigate Justice Alito’s conflicted interests and irregular recusal habits in the upcoming case Suncor v. Boulder. The Judiciary Committee should not permit Alito’s ongoing disregard of recusal standards to continue without investigation or inquiry.”
